Terms and Conditions

Last updated:

These terms explain how you can use our website and how we work with clients. We have tried to keep them short and in plain English. If anything is unclear, please email us and we will explain it.

Who we are

PBACopywriting is a trading name of Philemon Asrat, a sole trader. We are based in London, UK. In these terms, "we", "us" and "our" mean PBACopywriting. "You" means the person or business using our website or buying our services.

  • Trading name: PBACopywriting (PBAC)
  • Address for documents and legal notices: We are an online agency and do not have offices open to the public. Our postal address is: PBACopywriting, Office 21560, 182-184 High Street North, East Ham, London, E6 2JA
  • Email: ContactUs@PBACopywriting.com
  • Website: pbacopywriting.com

We are not a limited company, so we have no company number.

Part A: Using this website

A1. Using the site

You can use this website to learn about our services, see our prices and book a free call. Please do not misuse the site. For example, do not try to break into it, overload it, copy large parts of it, or send us harmful code.

A2. Prices on the site

The prices on this website are a clear guide to what our services cost. The service picker adds up the prices you choose so you can see an upfront total and a monthly total.

The service picker is not a shop. Picking services and sending the form does not place an order and does not create a contract. The price and scope that apply are the ones in your signed written agreement with us.

We work hard to keep prices correct. If a price on the site is wrong, we will tell you before you agree to anything, and we will not hold you to a price that was shown in error.

A3. Links to other websites

Our site links to other websites, such as Calendly for booking a call. We do not control those sites and we are not responsible for their content or how they use your data. Please read their own terms and privacy notices.

A4. The site may not always be available

We aim to keep the site running and correct, but we cannot promise it will always be available or free of errors. We may change or remove parts of it at any time.

A5. Who owns the site content

The words, design, images and logo on this website belong to us or the people who licensed them to us. You may view and print pages for your own use. Please do not copy or reuse our content for business purposes without asking us first.

A6. Information on the site

The information on this site is general. It is not advice for your business in particular. We are happy to talk through your situation on a call.

Part B: Our services

These service terms apply when you hire us. Your written agreement (a proposal or service agreement) sets out the details of your project. If your written agreement says something different from these terms, the written agreement wins.

B1. How our agreement starts

Nothing is bought on this website. After our call, we send you a written proposal or service agreement with the services, scope, price and start date.

Our contract starts when both of us sign that written agreement, or when you confirm by email that you accept it. Until then, neither of us is bound.

B2. Scope and prices

We only do the work set out in your written agreement. If you want something extra, we will tell you the price first and only start once you agree.

Our current services and guide prices are:

  • Website build: £850 one-off
  • Starter plan: £299 a month
  • Growth plan: £599 a month
  • Premium plan: £1,099 a month
  • Profile Care: £99 a month
  • Website Care: £49 a month (for clients who had a website build only)
  • Local Visibility Fix: £195 one-off (plus £95 if a new Google Business Profile has to be created)
  • Website copy refresh: £350 (up to 5 pages)
  • Welcome email sequence: £195 (included in Premium)
  • Advertorial: £175
  • Ads Essentials: £249 a month (£199 a month for Premium clients)
  • Ads Plus: £449 a month
  • Ads setup: £195 per ad platform
  • Migration and audit of a website we did not build: £95 one-off

Hosting and care are included in the Starter, Growth and Premium plans.

B3. Paying us

When invoices are sent, when they are due and how you pay are set out in your written agreement. If a payment is late, we may pause work after telling you in writing, until the payment is made.

B4. Monthly plans: minimum term and notice

Our monthly plans are Starter, Growth, Premium, Profile Care, Website Care, Ads Essentials and Ads Plus.

Each monthly plan has a minimum term of 3 months. After the first 3 months, the plan carries on month by month. You can cancel at any time after that by giving us 30 days' notice in writing. Email is fine.

You can give notice during the minimum term, but the plan will not end before the 3 months are up.

You can move up to a bigger plan at any time. You can move down to a smaller plan once your 3-month minimum is over.

B5. Changes to prices

We will never raise the price of a plan during its minimum term unless you agree. After the minimum term, we may change our prices. If we do, we will tell you in writing at least 30 days before the new price starts, so you have time to cancel if you wish.

B6. Website build

The website build fee (£850) covers the first build of your site, up to 5 pages, as set out in your written agreement. Extra pages are quoted before we start.

Before your site goes live, you review it and tell us if you approve. We only launch once you have approved it.

Changes after launch are covered by the edit time in your monthly plan, if you have one. Otherwise, we will quote for them separately before we start.

B7. Local Visibility Fix

We aim to finish the Local Visibility Fix in about 7 working days from when we have everything we need from you, including access to your Google Business Profile.

If you sign up to Starter, Growth or Premium within 30 days of paying for the Local Visibility Fix, we will take the £195 off your first month. The credit does not apply to Profile Care, Website Care or ads.

If you do not yet have a Google Business Profile, creating a new one costs an extra £95.

The Local Visibility Fix does not include:

  • appeals for suspended profiles
  • fake reviews or reviews given in return for a reward (we never do this)
  • any promise about where you will rank on Google

B8. Content and social posts

For plans that include content, we send you next month's content calendar by the 25th of each month.

You then have 2 working days to approve it or ask for changes. If we do not hear from you within 2 working days, we will publish the content as planned.

You get one round of changes each month. We ask you to send us photos of your business and your work. If we need more images, we may use licensed stock photos to fill gaps.

B9. Ads management

Ads Essentials and Ads Plus are add-ons to Starter, Growth or Premium. They have a 3-month minimum term, like our other monthly plans. If your plan ends, your ads add-on ends with it.

Ads Essentials covers up to £1,000 a month of ad spend. Above that, you move to Ads Plus. Ads Plus covers up to £3,000 a month, and we charge 15% of any spend above that.

Your ads run in Meta and Google accounts that you own. You pay the ad platforms directly for your ad spend. We never handle your ad spend and we never add a mark-up to it. Our fee is only for managing your ads.

If we agree a cost-per-lead target and we miss it for 2 months in a row, we will review the target and the plan with you.

Ad results depend on many things we do not control, such as your market, your offer and the ad platforms themselves. We do not guarantee any number of leads, sales or a set cost per lead.

B10. Hosting and website care

Hosting and care are included in Starter, Growth and Premium, or you can buy Website Care on its own for £49 a month.

This includes:

  • hosting on Cloudways, on servers in London
  • an SSL certificate (the padlock in the browser)
  • daily backups, each kept for 14 days
  • monthly updates to your site's software
  • uptime monitoring
  • a firewall

How fast we respond:

  • If your site goes down and you tell us by 5pm, we will fix it the same day. If you tell us after 5pm, we will fix it the next morning.
  • We make edits within 3 working days.
  • Unused edit time does not carry over to the next month.

We can move WordPress sites to our hosting for a one-off £95. Sites on other platforms, such as Wix, Squarespace or Shopify, cannot be moved, so we will talk about a rebuild instead.

No host can promise that a website will be online 100% of the time, so we do not make that promise. We will do our best to keep your site online and fix problems quickly.

B11. Your domain and leaving us

You own your domain name. We recommend that it stays registered in your name. You pay for your domain and its renewals, and we help you set it up.

If you stop your hosting with us, we will give you a full copy of your website so you can move it to another host. Your site is built with Elementor Pro. After you leave, you will need your own Elementor Pro licence to keep editing the site in the same way.

B12. What we need from you

To do good work, we need your help. You agree to:

  • give us the information, photos, logins and access we ask for, on time
  • make sure what you give us is accurate and that you have the right to let us use it (for example, photos and logos)
  • reply to approval requests within the times in these terms or your agreement
  • tell us about anything that could affect the work, such as rules that apply to your trade

If we are held up because we are waiting for something from you, our dates will move back by the same amount of time.

When you give us access to your accounts (such as your website, Google Business Profile or ad accounts), we will only use it to do the work you hired us for. You can take that access away at any time.

B13. Approvals

When you approve something, such as your website before launch or your monthly content, you are confirming you are happy with it. Please check facts, prices, opening times and contact details carefully. We are not responsible for errors in content you approved.

B14. No guarantees of results

We will do our work with reasonable care and skill. But we cannot control Google, social media sites or how customers behave. So we do not guarantee any rankings, traffic, leads or sales from any of our services.

B15. Who owns the work

Once you have paid in full for a piece of work, you own the final copy and content we made for your website and marketing.

We keep ownership of our own templates, tools, methods and know-how. We may reuse these for other clients, but we will never reuse the words written only for you.

Photos, fonts, plugins and stock images made by others stay owned by their makers and are used under their licences.

We may show the work we did for you in our portfolio and on our website. If you would rather we did not, just tell us and we will not.

B16. Keeping things private

We will keep your business information private. We will only share it when we need to in order to do the work (for example, with our hosting provider), or when the law requires it. You agree to do the same with any private information about our business that we share with you, such as our methods and pricing for your project.

How we handle personal data is explained in our Privacy Policy.

B17. Our responsibility to you

Nothing in these terms limits or excludes our responsibility for:

  • death or personal injury caused by our negligence
  • fraud or fraudulent misrepresentation
  • anything else that cannot be limited or excluded by law

Apart from those, if you are a business customer:

  • we are not responsible for loss of profits, sales, business or data, or for indirect losses
  • our total responsibility for any claim linked to a service is limited to the fees you paid us for that service in the 3 months before the claim arose

If you are a consumer, we are responsible for losses you suffer that were a foreseeable result of us breaking these terms or failing to use reasonable care and skill. We are not responsible for business losses, because our services are for use in your business.

B18. Ending the agreement early

Either of us can end the agreement straight away by writing to the other if:

  • the other seriously breaks the agreement and does not put it right within 14 days of being asked in writing, or
  • the other becomes insolvent or stops trading

If the agreement ends, you pay for work done and services provided up to the end date. We hand over anything you have paid for, and, if we host your site, a full copy of your website.

B19. If you are a consumer: your right to cancel

Most of our clients are businesses. But if you are buying as a consumer (for your own use, not your business), and the agreement is made at a distance, such as by email or phone, you have a legal right to cancel within 14 days. The 14 days start on the day after the agreement is made. You do not need to give a reason.

To cancel, email ContactUs@PBACopywriting.com and tell us clearly that you want to cancel. We will refund any payment within 14 days of hearing from you.

If you ask us to start work within the 14 days, and then you cancel, you will need to pay for the work we did up to the time you told us you were cancelling. If the work is fully finished within the 14 days at your request, you will lose the right to cancel for that work.

Consumers also have other legal rights, for example the right to services carried out with reasonable care and skill. Nothing in these terms affects those rights.

B20. Things outside our control

We are not responsible for delays or failures caused by events outside our reasonable control, such as outages at a hosting provider, Google or Meta, or serious illness. We will tell you as soon as we can and do our best to keep things moving.

B21. Complaints

If you are unhappy with anything, please email ContactUs@PBACopywriting.com. We will reply within 5 working days and work with you to put things right.

B22. Other legal points

  • If a court finds part of these terms cannot be enforced, the rest still applies.
  • If we do not enforce a right straight away, we can still enforce it later.
  • Only you and we have rights under this agreement. No one else can enforce it.
  • You may not pass your agreement to someone else without our written consent.
  • We may update these terms. Changes do not affect an agreement already signed unless we both agree in writing.

B23. Law and courts

These terms are governed by the law of England and Wales. Any dispute will be dealt with by the courts of England and Wales. If you are a consumer living in Scotland or Northern Ireland, you may also bring a claim in your local courts.
